It's an alternative mobility solution, but it shouldn't be taken lightly. Electric scooters do not require their drivers to have a driving license, but they still have to comply with traffic rules.

In fact, some cities have been preparing specific regulations for this type of vehicle, either to safeguard good practices in their use, or to safeguard road safety.

At stake, the safety of drivers and those around them. It should be recalled that, in 2018, and according to data released by the PSP, there were 1180 road accidents involving either electric scooters or electric bicycles.

Electric scooters: main rules of use

As a driving license is not required to drive an electric scooter, its drivers must be over 18 years old, in addition to their obligation to comply with traffic rules - which implies knowing the Highway Code.

In addition, whenever they travel by scooter, they must carry their citizenship card and cannot give a ride to other people. Scooters can only transport one person.

What does the Highway Code say about driving electric scooters?

According to Article 112 of the Highway Code, electric scooters are subject to the same rules as bicycles. In practice, this means that:

  • It is mandatory to respect all traffic rules
  • It is mandatory to have lighting and reflectors
  • Cannot exceed 25 km/h
  • It is not allowed to circulate on sidewalks, only on streets and bike paths
  • It is not allowed to use a cell phone or headphones while driving.
  • It is not allowed to lift the front or rear wheel when starting or driving
  • It is not allowed to drive with your hands off the handlebars.
  • Driving under the influence of alcohol is prohibited.
  • Although advisable, the use of a helmet is not mandatory (according to public clarification from the National Road Safety Authority)

What are the fines for those who do not comply with the rules?

Anyone who does not comply with these rules may pay a fine of up to €300.

Circulation and parking rules

In cities where electric scooters circulate there are so-called hotspots, the name given to the places where they are parked when no one is using them.

Although these are the indicated places to be parked, it is not uncommon to find them scattered throughout the city - as happens, for example, in Lisbon. For companies operating in this business, this type of practice turns out to be an advantage, but for city dwellers and visitors, it is a major nuisance in terms of mobility and even safety.

Like bicycles (electric or not), electric scooters can only circulate on streets and cycle paths. They cannot drive on the sidewalks.

Even knowing that this alternative mobility solution is relatively recent in Portugal (they started circulating on Portuguese roads in September 2018), there is still a long way to go in terms of good practices and respect for the legislation in force. Even so, both bicycles and electric scooters are very versatile, economical mobility solutions that promote environmental sustainability.

And what about insurance? In case of an accident, who is responsible?

In the event of an accident, you should call the authorities, contact the company that rents the scooter and take pictures of the vehicles involved.

Companies that rent these vehicles have their own insurance - as a rule, civil liability insurance that only covers the holder of the credit card associated with the application. However, bear in mind that any conduct considered to be faulty in the use of scooters makes this coverage unfeasible.

Now, if you are in the habit of traveling on an electric scooter regularly, our advice is that you consider taking out personal accident insurance to protect against this type of situation.
